LAMONICA HERBST & MANISCALCO, LLP (the “Firm”)
is a boutique business law firm consisting of seven (7) attorneys concentrating
in the practice of, among other specialties, Bankruptcy, Creditors Rights,
Commercial Transactions, Real Estate Transactions, State and Federal Court
litigation and other related matters.
The Firm was started in September, 1998 when the Partners departed from
a large Long Island law firm, Jaspan Schlesinger Silverman & Hoffman
LLP. The Firm has expanded significantly since its creation due to its
successful representation of clients throughout the metropolitan area.
With over eighty (80) years of combined legal experience, the Firm maintains
a high degree of integrity, responsibility and a long tradition of providing
clients with legal advice and services of impeccable quality. The Firm
is committed to maintaining and fostering diversity in its practice. We
offer particularly strong litigation capabilities for both trial and appellate
work. The Firm represents a diverse client base, including individuals,
corporations, receivers, institutional lenders, Official Committees of
Creditors and Court appointed Chapter 7 & 11 Bankruptcy Trustees.

The Firm has earned a reputation as an aggressive team of keen negotiators

same time maximizing recovery. We maintain an ongoing commitment to provide

From time to time, the Firm engages in community service and participates
in legal assistance and pro bono programs. Additionally, the Firm aims
to advance the legal profession, participating on bar association committees.
The Firm's partners are frequent lecturers in all areas of bankruptcy,
litigation, real estate and commercial transactions and believe in participating
in the community to offer assistance, as needed, in connection with pro
bono matters. One of the Firm’s partners, Joseph S. Maniscalco,
is the Chairman of the Bankruptcy Law Committee for the Nassau County
Bar Association and a frequent lecturer for the Credit Abuse Resistance
Education (CARE) Program.
CLIENT BASE
The Firm has established significant relationships with both large institutional
clients and small businesses and individuals. A brief cross section of
the Firms diverse client base includes being general counsel to institutional
clients and corporations, representing large and small Chapter 11 corporate
Debtors, several members of the panel of Bankruptcy Trustees for the Eastern
and Southern Districts of New York and numerous other small businesses
throughout the metropolitan area. The Firm also maintains a strong presence
representing local businesses in commercial transactions including buy/sells,
shareholder agreements and other corporate related transactions as well
as purchasing assets out of bankruptcy.
FINANCIAL ARRANGEMENTS
Financial arrangements for our legal services vary according to the nature
and complexity of the particular matter. For clients billed on an hourly
basis, rates are established for each attorney based on experience and
expertise. Occasionally, arrangements are made for contingency fees or
fees determined on another basis. Statements are generally submitted either
at the end of each month, quarterly or other periodic basis.
We believe all fee arrangements should be determined in advance of the
legal work, and that the client has a clear understanding of that fee
arrangement. Additionally, we believe that each client should be entirely
comfortable that their fee arrangement is satisfactory and fair. Many
clients prefer a retainer arrangement for general advice and counsel and
an hourly rate for individual matters not included within the retainer.
